THE PHENOMENON OF HOMONYMY IN MODERN ENGLISH LEGAL TERMINOLOGY SYSTEM
Abstract
The article is devoted to study of the phenomenon of homonymy in modern English legal terminology. The phenomenon of homonymy is traditionally characteristic of both general and specialized terminological vocabulary. Homonymous relations in terminology are natural and determined by certain factors, in particular, the lack of nominations for new concepts. Homonyms are two or more linguistic signs with the same sound that are not semantically related. At the current stage, the legal terminological system is dynamically developing due to the strengthening of the integration of countries and international relations and requires standardization and improvement of its terminology. The purpose of the work is to study the peculiarities of the phenomenon of homonymy in the modern English legal terminology system. In accordance with the main goal, the following tasks are solved in the work: 1) to characterize the phenomenon of homonymy within the terminological field of the legal sphere; 2) to study the processes of emergence of homonymous legal terms; 3) to identify types of terminological homonyms in the legal field; 4) to reveal the specifics of the functioning of the terms-homonyms of the legal sphere. The relevance of this work is due to the improvement of the legal field at the current stage and the need to standardize its vocabulary. The scientific novelty of the work is determined by the fact that it carries out a thorough analysis of the phenomenon of homonymy in the modern English legal terminology system. The types of homonymous terms in legal terminological field are identified. Among the homonymous terms of the legal terminology system, we distinguish cross-branch homonymous terms that function in non-adjacent scientific and technical spheres, cross-branch homonymous terms that belong to adjacent fields of application, intra-branch homonymous terms that are characterized by the same form of a lexical unit that has different meanings within the boundaries of the same scientific field, homonymous terms that function in common language and in the legal field at the same time. Cross-branch homonymous terms when used in non-adjacent scientific and technical fields do not interfere with the communication of specialists. Intrabranch homonymous terms are characterized by the same form of a lexical unit that has different meanings within the same scientific field. Such terms have disadvantages, as they interfere with the correct understanding of legal documentation. The theoretical value of this study is determined by its contribution to the general theory of the term. The results of the study enrich scientific knowledge about the specifics of the terminological nomination and the main processes of creating terms in the modern English legal terminology system.
